These terms ("Terms") are the agreement between you and TrueThinks Ltd, a company registered in England and Wales (company number 16779253) with its registered office at 128 City Road, London, EC1V 2NX, United Kingdom ("we", "us"). They apply to your use of Contentrue, our AI content studio and social media scheduling service, including our website and app (the "Service"). Please read them carefully. By creating an account or using the Service you accept them.
1. About the Service
Contentrue helps you plan, generate, review, schedule and publish social media content. It uses AI models from third-party providers to create images, text, narration and video, and connects to social networks (currently Instagram and X) through their official interfaces so we can publish on your behalf once you have approved a post.
2. Your account and workspace
- You must be at least 18 and able to enter a binding contract. If you sign up for an organisation, you confirm you have authority to bind it.
- Give us accurate information and keep your sign-in details secure. You are responsible for activity under your account and for the people you invite to your workspace and the roles you give them.
- Tell us promptly at hello@contentrue.com if you think your account has been compromised.
- Where you use the Service for a business or on behalf of clients, you are responsible for having the right to manage those accounts and content.
3. Free trial
Each user may have one free trial of 14 days, on their first workspace only, with a limited number of credits and the features of our Pro plan. We do not ask for payment details for the trial and we will not charge you unless you choose a paid plan. When the trial ends without a paid plan, your workspace becomes read-only: you can view and export your data, and posts you had already scheduled will still publish, but you cannot create new content, projects or connections. We may refuse or end a trial where we reasonably suspect it is being used to avoid paying.
4. Plans, credits and payment
- Plans. Paid plans (Starter, Pro, Agency), their prices, limits and features are shown on our pricing page. Prices are in pounds sterling and are shown excluding VAT; for UK customers we also show the price including UK VAT at 20%. VAT for other countries is calculated at checkout, and business customers with a valid VAT ID may be able to reverse-charge it where the law allows.
- Credits. Plans include a monthly allowance of credits, which pay for AI usage. A credit is a unit of account representing roughly one US cent of the cost charged to us by AI providers. Your monthly allowance renews at the start of each billing period and does not roll over. You can also buy one-off credit packs, which do not expire while your account is active. Credits have no cash value, cannot be transferred and are not refundable except where the law requires. If a generation has already started when your balance runs out, we may let it finish and your balance may go slightly negative.
- Payment. Payments are processed by Stripe. You authorise us to charge your chosen payment method for the plan, any credit packs and applicable taxes. If a payment fails we will tell you and retry. While a payment is overdue we may stop new content generation straight away; scheduled posts keep publishing for a grace period of 7 days, after which we may pause publishing and suspend the account until the payment is made.
- Changes to prices. We may change prices for future billing periods. We will give you at least 30 days' notice by email before a price change applies to you, and you may cancel before it takes effect.
5. Automatic renewal and cancellation
Subscriptions renew automatically at the end of each billing period (monthly or yearly) until cancelled. We will send you renewal and other reminders as the law requires. You can cancel at any time from the billing portal in the app. Cancellation takes effect at the end of the period you have already paid for; you keep access until then. We do not give refunds for the unused part of a billing period after you cancel, except as set out in our Refund & Cancellation Policy or where the law requires.
6. Consumers: your 14-day right to cancel
If you are a consumer, meaning you use the Service wholly or mainly outside your trade, business, craft or profession, you have the right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel a new subscription or credit-pack purchase within 14 days of buying it, without giving a reason. At checkout we ask you to expressly request that the Service begins immediately and to acknowledge that, if you cancel within the 14 days, you must pay for what you have already used. In that case we will refund what you paid, less an amount proportionate to the part of the Service already provided (including credits used). If the Service has been fully provided with your prior express consent and acknowledgement, you lose the right to cancel. Details and how to exercise the right are in our Refund & Cancellation Policy.
7. Acceptable use
You must use the Service in line with our Acceptable Use Policy. In particular you must not use it to send spam, publish deceptive or unlawful content, create deepfakes of real people without their consent, or infringe anyone's rights. We may remove content or suspend access where we reasonably believe this Policy has been breached.
8. Your content and AI output
- Your content. You keep all rights in the material you upload or provide (including brand kits, prompts, logos and images) ("Your Content"). You give us a limited, worldwide licence to host, process, adapt and transmit it solely to provide the Service to you, including sending it to AI providers and the social networks you connect.
- AI output. Images, text, narration and video generated for you ("Output") are produced by AI. As between you and us, and to the extent permitted by law and by the AI providers' terms, you may use Output for your own business purposes. Output may be inaccurate, offensive, biased, or similar to other people's output, and AI-generated material may not be protected by copyright in some countries. We do not promise that Output is accurate, original or free of third-party rights.
- Your responsibility. You are responsible for reviewing Output before you approve it, for checking facts, for lawful use of any names, likenesses, music or brands, and for the content published to your accounts. Contentrue only publishes what you or your team approve.
- Disclosure. Some laws and platforms require you to disclose AI-generated or synthetic media. We provide labelling options, described in our AI Transparency note; you remain responsible for complying with disclosure rules that apply to you.
- No training on your content. We do not use Your Content to train AI models, and we use provider services whose terms do not allow them to train on it by default.
9. Third-party platforms and providers
The Service depends on third parties, including Meta (Instagram and Facebook), X, Stripe and AI providers. Your use of those networks is governed by their own terms and policies, including the Meta Platform Terms, Instagram Terms of Use and the X Developer Agreement and policies, and you must comply with them. Connected accounts stay yours; you can disconnect them at any time. Platforms may change or restrict their interfaces, limit publishing, label content or suspend accounts without involving us, and we are not responsible for those decisions or for features a platform withdraws.
10. Intellectual property
We and our licensors own the Service, including software, design and documentation, and all related intellectual property. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose during your subscription. Some components are provided by third parties under open licences; see Attributions. If you give us feedback we may use it without obligation to you.
11. Availability and changes to the Service
We aim to keep the Service available and to publish scheduled posts on time, but we do not promise uninterrupted or error-free operation. We may carry out maintenance, and the Service depends on third-party systems outside our control. We may improve, change or withdraw features. If we make a change that materially reduces what you paid for, we will tell you and you may cancel.
12. Data protection
Our Privacy Policy explains how we handle personal data. Where we process personal data in Your Content on your behalf, our Data Processing Addendum forms part of these Terms.
13. Our liability
- Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
- Consumers. If you are a consumer, your statutory rights are not affected. In particular, we must provide the Service with reasonable care and skill. We are liable for losses that are a foreseeable result of our breach, but not for losses that were not foreseeable, and we have no liability for business losses because you use the Service for personal purposes.
- Businesses. If you are not a consumer, we are not liable for loss of profit, revenue, goodwill, data or business opportunity, or for any indirect or consequential loss, and our total liability for all claims arising out of or in connection with the Service in any 12-month period is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for loss caused by third-party platforms or providers, by your content, or by your failure to review Output.
- The Service is provided on an "as available" basis. Except as stated in these Terms, and to the extent the law allows, we exclude all implied terms.
14. Suspension and termination
You may stop using the Service and close your account at any time (see Data Deletion). We may suspend or terminate your access if you materially breach these Terms and do not fix the breach within a reasonable period after notice, if payment remains overdue, if we are required to by law or a platform, or immediately where your use poses a serious risk to others, to the Service, or is clearly unlawful. When your subscription ends, your workspace becomes read-only and you can still export your data. If a workspace has had no active plan for 90 days (and has not been granted free access by us), we schedule it for deletion; we email you 14 days and 3 days before that happens. After scheduling there is the usual 7-day period in which it can still be restored, then its content and media are permanently deleted, about 97 days in total after your plan ended, unless the law requires us to keep it. Clauses that by their nature should survive termination will do so.
15. Changes to these Terms
We may update these Terms, for example to reflect changes in the Service, the law or our providers. We will tell you of material changes at least 30 days in advance by email or in the app. If you do not agree you may cancel before they take effect; continuing to use the Service afterwards means you accept them.
16. General
- These Terms, together with the documents they refer to, are the entire agreement between us about the Service.
- We may transfer our rights and obligations to another organisation if that does not reduce your rights. You may not transfer yours without our written consent.
- If a provision is found unenforceable, the rest remains in force. Failing to enforce a right is not a waiver of it.
- Only you and we have rights under these Terms; nobody else can enforce them under the Contracts (Rights of Third Parties) Act 1999.
- We will contact you by email or through the app. You can contact us at hello@contentrue.com.
17. Governing law and courts
These Terms and any dispute or claim arising out of or in connection with them are governed by the law of England and Wales. If you are a business, the courts of England and Wales have exclusive jurisdiction. If you are a consumer, you may bring proceedings in the courts of the part of the United Kingdom where you live (or, if you live in the EU, where mandatory local law gives you that right), and your local mandatory consumer protections continue to apply.
